Farm to Farm Conditions

Aberdeen & Northern Marts Particular Conditions of Sale relating to Farm to Farm Sales of Store Cattle

 

These Particular Conditions together with Aberdeen & Northern Marts General Conditions and the Special Conditions of Sale Relating to Store Cattle shall apply to all auction and other sales of Store Cattle conducted by Aberdeen & Northern Marts (a trading division of ANM Group Ltd), Thainstone Centre, Inverurie, Aberdeenshire and every seller, bidder and purchaser by taking part in the sale acknowledges to have received prior written notification of these Particular Conditions and of the General Conditions and of the Special Conditions and be bound by them. Where the aforesaid General Conditions and/or the aforesaid Special Conditions are inconsistent with the Particular Conditions the Particular Conditions shall prevail


1. Descriptions

In a farm to farm sale the goods shall be sold by description. Said description shall be material only in respect of breed, sex and age. The Auctioneer's assessment/comment in respect of other matters is indicative only and not material and does not constitute any warranty whatsoever.


2. Weights

Cattle to be sold per kilo based on an estimated average weight, based on lorry weights minus 3% off gross weight rounded down to the nearest kilo. Animals to be weighed (tare and gross weight) at nearest approved weighbridge to seller's holding. Weighbridges charges to be the responsibility of the seller. Cattle will be sold on an estimated average weight with a 20 kilo tolerance on each side where the sale price per kilo will remain unaltered. When the actual average weight is outwith this tolerance a sale price adjustment to the bid price will be triggered as follows:- Average actual weights above this tolerance will reduce the sale price per kilo, by 0.1p/kilo and conversely, average actual weights below this tolerance will incrementally increase the sale price per kilo by 0.1p/kilo respectively.


3. Uplift and Haulage Charges

All stock to be uplifted within seven days of date of sale. Haulage charges ex farm to be the responsibility of the buyer.


4. Payment Terms

Full payment due by purchasers within seven days of invoice date for which normal discount will be paid. If payment is not received within seven days of invoice date, interest at 4% over base rate will be charged. Payment to sellers three days after receipt of weight tickets.
